Terms of Service
Version: 2026-10-28-r6 · Last updated: October 28, 2026
These Terms are an agreement between you and Top Apps LLC ("Vidifier," "we," "us"). They govern Vidifier's website, iPhone, iPad, and Mac applications, AI generation and editing services, and related features (the "Service"), including free, trial, subscription, and credit-based use. Our Privacy Policy explains how we process personal information.
By tapping a purchase or creation button beside a notice stating that the tap signifies agreement to these Terms, you agree to these Terms. If you do not agree, do not submit content or use the generation features. These Terms do not retroactively govern conduct before your acceptance. Downloading the app alone is not our record of acceptance of these Terms.
1. Eligibility and authority
The Service is available to users aged 4 and over. You must be at least 18, or the age of legal majority where you live if higher, and legally able to enter this agreement to accept these Terms yourself. A user aged 4–17 may use the Service only when their parent or legal guardian reviews and accepts these Terms on their behalf and supervises their use. If local law requires parental authorization for an older minor, that requirement also applies. A minor must ask their parent or guardian to complete the agreement step; a minor's statement that a parent agrees is not a substitute. Any legally required parental notice, verifiable consent, and other protections for children's personal information must be satisfied before that information is collected, used, or disclosed. Accepting these Terms alone does not replace those requirements.
If you accept as a parent or guardian, you confirm your authority and agree to these Terms for yourself and for your child's authorized use, to the extent permitted by law. If you act for a business, you confirm that you can bind that business. An App Store age rating does not replace these requirements.
2. Apple license and third-party services
The app remains licensed under Apple's Standard End User License Agreement. These Terms supplement that license with rules for Vidifier's services; they do not replace Apple's license or reduce rights it or mandatory law gives you. Apple is not a party to these service Terms and does not provide Vidifier's AI services.
Vidifier uses third-party infrastructure and AI model hosting providers. Generation requires sending the selected content and instructions to these providers, including for safety checks, as disclosed in the Privacy Policy linked beside the creation action. You must comply with lawful restrictions applicable to use of the Service. Third-party services may change or become unavailable.
3. Your inputs and permissions
"Inputs" include photos, images, video, prompts, and other material you submit. You retain any rights you already have in your Inputs. You represent that you have all rights and permissions needed to submit, transform, and use that material, including applicable copyright, privacy, publicity, and likeness permissions. Owning a copy of a photo does not necessarily give you every right in it or in the people it depicts. Do not submit confidential or sensitive information that you are not authorized to disclose.
You grant Vidifier a nonexclusive, worldwide license to host, copy, transmit, process, and transform your Inputs, and to allow our service providers to do so, only as reasonably needed to provide the requested features, maintain and secure the Service, address misuse or complaints, and comply with law. This is not a transfer of ownership or permission for us to publish your private creations as marketing. We do not use your Inputs or Outputs to train our own AI models.
4. Acceptable Use Rules
You must not use the Service, Inputs, or generated images, videos, or audio ("Outputs") to create, attempt, facilitate, distribute, or promote:
- Unlawful activity, material, transactions, or instructions, including exploitation, trafficking, or credible threats of violence.
- Child sexual abuse or exploitation material, sexualized depictions of minors, or attempts to produce such material, including synthetic, altered, or fictional depictions.
- Nonconsensual intimate imagery, sexual deepfakes, nudification, voyeuristic material, or sexually explicit or pornographic content.
- Fraud, scams, extortion, deceptive impersonation, fabricated evidence, or misleading depictions intended to harm, defraud, or falsely implicate a person.
- Harassment, stalking, bullying, hateful abuse, defamation, or violations of another person's privacy, likeness, publicity, copyright, trademark, or other rights.
- Malware, security attacks, unauthorized access, theft of credentials, or interference with the Service or another person's access.
You must not bypass moderation, disguise prohibited instructions, evade restrictions or suspensions, misuse purchase or credit systems, or automate abusive requests. You remain responsible for compliance with applicable laws when using or distributing Outputs, including any required disclosures that media was generated or altered by AI.
5. Outputs and your responsibility
As between you and Vidifier, you may use Outputs for lawful personal or commercial purposes, subject to these Terms and any applicable third-party rights. To the extent we hold transferable rights in an Output, we assign those rights to you. We cannot grant rights that belong to someone else. AI Outputs may not qualify for copyright protection and may resemble other people's content.
You must review Outputs before relying on, publishing, selling, or sharing them. AI can produce unexpected, inaccurate, offensive, or infringing results even from an apparently harmless Input. A successful generation or a passed safety check is not legal clearance, approval, endorsement, or a representation that an Output is safe, accurate, original, or lawful. You are responsible for your instructions and your use and distribution of Outputs; that allocation does not excuse Vidifier from obligations that law places on us.
6. Safety, complaints, and enforcement
We and our providers may apply automated safety checks and review information when investigating misuse or complaints. These measures have limits and may make mistakes. We do not promise that every Input or Output is reviewed or that all prohibited conduct will be detected.
We may reject a request, restrict or suspend access, or terminate use when reasonably necessary to address a breach, protect others or the Service, comply with provider requirements, or satisfy legal obligations. We may preserve information, respond to valid legal process, and make legally required reports. Where appropriate and legally permitted, we will give notice and a way to contact us about a restriction. Mandatory consumer rights and refund obligations remain applicable.
Report harmful content, suspected infringement, or other misuse to support@vidifier.com. Include a description and relevant job identifier or other locating information if available. Do not email unlawful images or unnecessary sensitive information. Contact emergency services directly if someone is in immediate danger.
7. Subscriptions, credits, and saved media
Prices, trial eligibility, renewal periods, included allowances, and generation costs are shown in the app and Apple's purchase interface. Subscriptions renew automatically unless canceled through your App Store subscription settings. Removing the app, declining new Terms, or withdrawing AI permission does not itself cancel a subscription. Apple handles App Store payments and applicable refund requests; your statutory rights are unaffected.
Subscription and trial credit grants may expire as disclosed in the app. Purchased credit packs and failed-run compensation do not expire under the current credit policy. Generation requires sufficient available credits where applicable; audio access may require an active subscription. We do not promise every attempt will succeed. Service errors and credit compensation are handled under the purchase disclosures and applicable law. Changes to paid benefits apply with any notice or consent required by law; these Terms do not authorize confiscation of purchased balances contrary to law.
History and exported media are stored on your device. Vidifier is not a backup or permanent media-storage service. Keep independent copies of creations you wish to retain. Resetting the interface or closing the app does not necessarily cancel work already submitted.
8. Disclaimers
To the fullest extent permitted by law, the Service and Outputs are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and noninfringement, and do not guarantee uninterrupted availability or a particular creative result. No disclaimer removes any guarantee, remedy, or right that cannot lawfully be excluded.
9. Limitation of liability
To the extent permitted by applicable law, Vidifier will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, business opportunities, goodwill, or data, arising from the Service or Outputs. Our aggregate liability to you arising from these Terms or the Service will not exceed the greater of US $100 and the amounts you paid for Vidifier during the 12 months before the event giving rise to the claim.
These exclusions and limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability to the extent it cannot lawfully be excluded or limited. If consumer law where you live requires a different remedy or limit, that law controls. These provisions allocate risk between you and Vidifier; they do not purport to eliminate duties to third parties or authorities.
10. Claims arising from your misuse
To the extent permitted by law, you agree to indemnify and hold harmless Top Apps LLC and its personnel from third-party claims, damages, and reasonable defense costs to the extent caused by your unlawful Inputs, your infringement of another person's rights, your material breach of these Terms, or your unlawful use or distribution of Outputs. This obligation does not apply to the extent a claim is caused by our own negligence, misconduct, or breach of law, or where imposing it would violate consumer law.
We will give reasonable notice of a claim and allow reasonable participation in its defense. Neither party may settle a claim in a manner that admits fault for or imposes nonmonetary obligations on the other without that party's consent. This section does not waive legal rights of minors or impose obligations on a person who has not validly agreed to them.
11. Changes, ending use, and disputes
We may revise these Terms. We will identify the revised version and provide notice of material changes. When a new agreement is required, new generation requests will require acceptance of that version. Revisions do not retroactively change accrued rights or claims. You may stop submitting content at any time, keep permitted exported creations, and manage or cancel subscriptions through Apple.
Applicable law determines governing law and jurisdiction; we do not use these Terms to deprive consumers of mandatory protections or access to courts where they live. Contact us first if you wish to try to resolve a concern informally. These Terms do not require arbitration or waive class-action rights. If a provision is unenforceable, the remaining provisions apply to the extent lawful. Provisions that by their nature should survive termination continue subject to applicable law.
